Terms of Use

1. Introduction and Acceptance

Welcome to Mister Education (the "Platform", the "Service", "we"). These Terms of Use (the "Terms") govern your access to and use of the Platform. By creating an account, accessing or using the Service, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

These Terms incorporate, where applicable, the General Data Protection Regulation (Regulation (EU) 2016/679, the "GDPR") and the Brazilian General Data Protection Law (Lei nº 13.709/2018, the "LGPD").

2. The Service

Mister Education is an online language-learning platform that uses artificial intelligence to provide conversation practice, error correction, personalised feedback and adaptive exercises. AI-generated output may contain inaccuracies; the Service is not a substitute for professional advice, official certification or accredited instruction.

3. Eligibility and Account

You must be at least 13 years old to use the Service. Users under 18 require parental or guardian consent. You are responsible for providing accurate information, keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised access.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent or abusive purposes;
• Bypass technical limits, security measures or billing systems;
• Reverse-engineer, scrape or perform mass data extraction;
• Submit content that is offensive, discriminatory, defamatory or infringes third-party rights;
• Use the AI to generate unlawful or harmful content or content that infringes copyright;
• Resell, sublicense or commercially exploit the Service without authorisation.

5. Plans, Payment and Cancellation

We offer free and paid plans. Prices, conditions and features for each plan are described on the pricing page. Subscriptions renew automatically until cancelled.

Right of withdrawal (EU consumers): consumers in the EU may withdraw from a distance contract within 14 days of subscription, in line with Directive 2011/83/EU. Where the Service has begun with your express consent, withdrawal does not entitle you to a refund of the period already used.

Right of repentance (Brazilian consumers): under article 49 of the Brazilian Consumer Defense Code, you may cancel a distance contract within 7 days, with full refund.

6. User Content

You retain ownership of the content you submit (text, audio, messages). You grant Mister Education a non-exclusive, worldwide, royalty-free licence strictly necessary to operate the Service, including AI processing, response generation and aggregated, anonymised product improvement. We do not use your identifiable content to train third-party models without your consent.

7. Intellectual Property

The brand, logo, text, layout, software and content of the Platform are owned by Mister Education or its licensors and are protected by applicable copyright and trademark law. Reproduction without prior written authorisation is prohibited.

8. Personal Data Protection (GDPR & LGPD)

We process personal data under the GDPR and, where applicable, the LGPD. Full details are in our Privacy Policy. In summary:

8.1 Controller

8.2 Lawful Bases

We rely on the following lawful bases: (i) performance of a contract (Art. 6(1)(b) GDPR / art. 7, V LGPD); (ii) consent (Art. 6(1)(a) GDPR / art. 7, I LGPD); (iii) legitimate interests, where applicable (Art. 6(1)(f) GDPR / art. 7, IX LGPD); and (iv) compliance with legal obligations.

8.3 Your Rights

You may, free of charge, exercise the following rights at any time:

• Access your personal data;
• Rectify inaccurate or incomplete data;
• Erase data ("right to be forgotten") where applicable;
• Restrict or object to processing;
• Data portability to another provider;
• Withdraw consent at any time, without affecting prior lawful processing;
• Not be subject to a decision based solely on automated processing that produces legal or similarly significant effects (Art. 22 GDPR / art. 20 LGPD);
• Lodge a complaint with a supervisory authority: in the EU your local DPA, or the Brazilian National Data Protection Authority (ANPD).

8.4 Retention

We retain personal data for as long as necessary for the purposes for which it was collected, or as required by law (e.g., the Brazilian Civil Internet Framework requires 6 months retention of access logs; tax obligations require 5 years).

8.5 International Transfers

The Service may involve international data transfers (e.g., to AI providers, hosting, payment processors). Such transfers occur to countries deemed adequate or under appropriate safeguards such as the EU Standard Contractual Clauses (Art. 46 GDPR) and the equivalent guarantees under art. 33 LGPD.

8.6 Cookies

We use strictly necessary cookies and, with your consent, analytics and performance cookies. You may manage your preferences at any time.

9. Artificial Intelligence

The Service relies on generative AI models. Automated decisions (e.g., proficiency assessment, content recommendations) can be reviewed on request, in line with Art. 22 GDPR and art. 20 LGPD. AI output may be incorrect and should be used with critical judgement.

10. Limitation of Liability

The Service is provided "as is". To the fullest extent permitted by law, Mister Education is not liable for indirect, incidental or consequential damages, lost profits or data loss arising from force majeure, third-party failures or user misuse. Nothing in these Terms limits rights granted to consumers by mandatory law.

11. Suspension and Termination

We may suspend or terminate accounts that breach these Terms, with notice where legally required. You may close your account at any time from the account area or by contacting support.

12. Changes

We may update these Terms. Material changes will be communicated through the app, by email or on the website with reasonable advance notice. Continued use after the effective date constitutes acceptance.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Disputes will be resolved at the consumer's domicile court, unless mandatory law provides otherwise. EU users retain the consumer-protection rights of their country of residence.
